2009 Terms and Conditions of Enrolment

Terms and Conditions apply to every student enrolled with Framework Solutions Ltd whether the enrolment is arranged personally or through another organisation. Read them carefully before you complete and sign the Declaration section of the Enrolment Form 2009. In signing the Enrolment Form 2009, you are confirming that you have read, understood and accepted these Terms and Conditions and the Privacy Act 1993 Statement.

Fees

In signing the Enrolment Form 2009 you undertake to pay all fees as they become due, and to meet any late fees and collection charges associated with debt recovery. The organisation's policy on withdrawal and refund of fees is noted below. Any fees paid to Framework Solutions Ltd prior to course commencement are banked upon receipt for security reasons.

Enrolment Date

On receipt at Framework Solutions Ltd, your Enrolment Form 2009 will be checked to ensure you are eligible to enrol at Framework Solutions Ltd, and in the programme and course(s) requested. Your form will also be checked for date, signature, completeness and all necessary documentation. If necessary information is missing, or fees have not been paid in full, your Enrolment Form 2009 will not be confirmed until all information or fees are provided. The date on the confirmation of enrolment letter will be the official date of enrolment.

Amendments to your Proposed Course of Study

Framework Solutions Ltd reserves the right to make amendments to your proposed course of study during 2009 where such amendments are necessary to comply with programme regulations, course requirements, or where it is necessary to restrict enrolments, or courses are unavailable to enrol in for any reason.

Availability of Courses

You agree:

  • Enrolments are in individual courses, not the complete programme.
  • Framework Solutions Ltd does not undertake that you will be able to complete or achieve an award or qualification through study with it.
  • Not all programmes, or courses are open for enrolment in any given semester or year.

Regulations

You agree to abide by the regulations and policies of Framework Solutions Ltd. These are available on www.framework.co.nz, and are published in the 'Candidate Handbook', or available from the Framework Solutions Ltd office on 0800 375 488.

Withdrawals and Refunds

Refunds of fees will be in accordance with the requirements of the Education Act 1989 Section 236 (A). Refunds may be provided to candidates who withdraw from the course within eight (8) calendar days from their acceptance of *enrolment date.

Policy where the candidate fee has already been paid

If a candidate withdraws within eight (8) calendar days from their acceptance of enrolment date the candidate is entitled to a refund of the fees paid less an administration fee limited to 10% of the fees paid or $500, whichever is the lesser. If a candidate withdraws after the eighth (8th) day, i.e. day nine (9) onwards, then no refund is due to the candidate.

  • The acceptance of enrolment date is the day on which the course is offered to the candidate and they formally accept the offer by completing and signing the enrolment form.

Candidates who withdraw before the course commences will be subject to the above criteria. That is, they will be entitled to refund less any amounts allowed to be retained by the provider.

Refunds for candidates who withdraw outside this timeframe will be dealt with on a case by case basis.

A form is available from the Framework Solutions Handbook for this purpose. The date of withdrawal is the date when your written or faxed withdrawal is received by Framework Solutions Ltd. You will be eligible for a refund of fees provided that:

  • Your course has not been transferred,
  • You have returned all study material,
  • No work has been received by Framework Solutions Ltd, and
  • No class has been attended (where applicable).

All withdrawals must be notified in writing.

Duration of an Enrolment

Your course enrolment will expire EITHER:

  • At the end of the fixed period or semester for which you have enrolled OR
  • Twelve months from the date of confirmation of enrolment OR
  • When you complete all the summative assessments required for the course WHICHEVER COMES FIRST.

Variations to Conditions of Enrolment

No modification, alteration of or addition to these conditions of enrolment shall be binding on the parties unless it is in writing and signed by Framework Solutions Ltd and the student.

Complaints Procedure

If you are not happy about aspects of the training programme, you have several ways of expressing your concerns. Please try number one first and work through the list if necessary.

1. Talk directly, or with a supporter, to your trainer or tutor, at an appropriate opportunity and work together to address your concerns.

2. Ask your employer or industry representative to take up your concerns.

3. Make a complaint to Framework Solutions Ltd. To do this, put your concerns in writing and send them to

All complaints will be investigated within 21 days.

4 Contact the NZ Association of Private Education Providers [NZAPEP] Quality Commissioner. To do this send an email to commissioner@qualitycommission.co.nz or free phone 0508 266 647 or go to the website www.qualitycommission.co.nz.

5. If you are not satisfied with your responses from Framework Solutions Ltd contact the New Zealand Qualifications Authority [NZQA] and make a formal complaint. To do this write to:

PRIVACY ACT 1993

Authorisation

By signing the Enrolment Form 2009 or Re-enrolment Form, you have authorised Framework Solutions Ltd to collect, use and disclose personal information about yourself in accordance with the sections specified below and the Privacy Act 1993. You have also authorised any agency holding the source of information you have provided on this form to release that information to Framework Solutions Ltd on request.

Use of Personal Information Gathered

You are advised that information sought on Enrolment Form 2009 Forms, associated documents, and collected from you during your period of enrolment at Framework Solutions Ltd is required to enable Framework Solutions Ltd to comply with its purposes and functions under the Education Act 1989. Without affecting the generality of the above statement, the information will be held by Framework Solutions Ltd and used in the following ways:

  1. Framework Solutions Ltd will use the information collected and stored to comply with the requirements of the Ministry of Education (student statistical returns), New Zealand Qualifications Authority (record of learning registration and unit standard outcomes), Tertiary Education Commission (funding returns), Industry Training Organisations (funding and academic outcomes), Ministry of Social Development (confirmation of enrolment and academic outcomes), Inland Revenue Department (student loan interest rebate), Department of Immigration (if you are not a New Zealand citizen or permanent resident), and agencies who support particular students through scholarships and prizes, payment of fees or other awards (if you are a recipient of one of these awards). The information is also used to select students for qualifications, to manage internal administrative processes, for providing tuition, academic advice and support, for internal reporting, to provide you with information on Framework Solutions Ltd courses and programmes and for maintaining order and discipline. To advise you of Framework Solutions Ltd's Alumni Programme and activities. It may also be used to put you in contact with other students studying your course(s) if you specifically authorise this. Information may also be given to textbook/learning resource suppliers to assist you to purchase textbooks, learning resources, stationery, etc. If you are successful in your course and become eligible to attend a Framework Solutions Ltd graduation ceremony, your name will be published in the list of graduands in the programme for that graduation ceremony.
  2. Framework Solutions Ltd may also be required by law to provide some personal information to other Government agencies upon request (for example, New Zealand Police).
  3. Information about particular students may be supplied to the following agencies in the circumstances detailed below:
    • Other education institutions and providers
      • where the student concerned is enrolled in a course taught at another institution in association with Framework Solutions Ltd
      • where the student concerned is transferring his or her records to that other institution or applying to enrol in a course taught at that institution
      • where the student concerned is enrolled in a course leading to a qualification awarded by another body or institution
      • where the student has been enrolled at Framework Solutions Ltd but is receiving student support at another institution or organisation in association with Framework Solutions Ltd
      • where the student concerned has enrolled at Framework Solutions Ltd pursuant to a contract Framework Solutions Ltd has with any Industry Training Organisation
      • where the student has enrolled at Framework Solutions Ltd pursuant to a contract Framework Solutions Ltd has with any secondary school.
    • An Employer – where a student has enrolled at Framework Solutions Ltd under a contract Framework Solutions Ltd has with the employer whereby the employer pays or has agreed to pay the student's fees.
    • Department of Work and Income – where the student concerned is being funded by DWI
    • Ministry of Foreign Affairs and Trade – where the student concerned is funded by the Ministry.

Note:

  1. Framework Solutions Ltd undertakes to observe the general conditions governing the release of information, as set out in the Privacy Act 1993 and the post-compulsory unique identifier code of practice. You may see any information held about you and amend any errors in that information. To do so, contact the Academic Registrar.
  2. The Privacy Act came into force on 1 July 1993 with the stated aim of protecting the privacy of natural persons. It requires the organisation to collect, hold, handle, use and disclose personal information in accordance with the twelve Information Privacy Principles in the Act.
